is Traffic Accident Reconstruction?
Reconstructing
a traffic collision involves determining how the collision occurred.
It may involve determining the speeds at, or prior to impact,
for the vehicles involved. Thereafter the Reconstructionist will
determine where each party to the collision was in the seconds
proceeding the impact. Not only is this helpful in understanding
how the collision occurred, but it is also helpful in analyzing
what if any opportunity existed for either party to avoid the
collision.
Traffic accident
Reconstruction is part science and part art. The science is the
data collection and calculations. The art is assisting your client
in understanding the strengths of the case as well as any weaknesses.
An experienced expert can often assist in developing a strategy
suitable for use in examining the opposing expert and defusing
his/her positions or opinions.
In order to
perform a reconstruction an expert will need to examine certain
materials that may be provided. Examples of materials needed for
review are:
- Police
accident reports and investigations
- Photographs
of the damaged vehicle
- Photographs
of the collision scene
- Statements
from drivers, vehicle occupants and witnesses
- Legal Pleadings
which set forth the complaint
- Pre-trial
depositions from any of the above individuals
In addition,
the reconstructionist may inspect the scene of the collision;
measure and diagram the roadway(s); examine and/or measure the
damaged vehicles; and determine if any vehicle systems or vehicle
components played a role in the collision. As part of a thorough
analysis, the expert should check recall databases and records
of complaints if there is a suspicion that a particular component
or vehicle system may be involved.
After a thorough
analysis the expert may be asked to offer opinions, either verbally
or in writing. Thereafter preparation for deposition or trial
may begin.
